AG: FBI helped bust Smith.

Attorney General Jim Hood issued the following statement and mug shot:

Hinds County District Attorney Arrested, Accused of Illegally Consulting Criminal Defendants

Jackson, Miss.- Hinds County District Attorney Robert Shuler Smith was arrested today following a joint investigation by the Attorney General’s Office and the FBI into allegations that Smith illegally advised or defended individuals charged with crimes, Attorney General Jim Hood announced today.

Smith, 45, of Jackson, was arrested at his office by investigators with the Attorney General’s Office and the Hinds County Sheriff’s Office. Smith was charged with six counts of violating Mississippi Code Section 97-11-3, a misdemeanor. That law states that the attorney general or district attorney shall not “consult, advise, counsel or defend” a person charged with a crime or misdemeanor.

The joint investigation between the Attorney General’s Office and FBI revealed that Smith violated Mississippi law related to his involvement with two different criminal defendants while serving as district attorney.

Smith was booked into the Hinds County Jail. If convicted, Smith could be removed as district attorney and prohibited from holding any other elected office or government position. Additionally, he faces a $500 fine.

“It is particularly sad to have to prosecute and seek removal from office a fellow prosecutor,” said Attorney General Jim Hood.  “We greatly appreciate the hard work of the FBI on this case and we hope to resolve this as soon as possible.”

“Those who are sworn to uphold the law are not above the law,” said Donald Alway, special agent in charge of the FBI in Mississippi. “Though today’s charges are only allegations, public corruption poses a fundamental threat to our national security and way of life. It impacts everything from how well our borders are secured and our neighborhoods protected…to verdicts handed down in courts. The FBI appreciates the close cooperation on this matter with the Mississippi Attorney General’s Office.”

As with all cases, a charge is merely an accusation, and a defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.

Seen this 'joint investigation' trope used too many times by Pickering to know that the salient question remaining to be answered is who brought the Feds in? AND, knowing Hood's well-documented aversion to prosecuting friends, family and Democrats, if it wasn't Hood did the Feds force Hoods' hand?

I'm no fan of RSS, but he must be cleaner than I thought he was if all Hood and the FBI can come up with on him is "He visited a guy in jail for 20 minutes". How much time and effort went into accusing him of a misdemeanor? I want him gone, but I can only imagine how this hearing is going to go. "Mr. Smith, you're accused of providing counsel to a person charged with a crime. How do you respond?". "I didn't provide legal counsel, I was asking Mr. Butler for his biscuit recipe". "Oh, well never mind then, case dismissed".

Need to go read the various comments on some 'leading leader's' FB pages. What RSS did is ok, because he is black. According to the comments, "white folks do it all the time", and the crime isn't too bad.

Obviously, according to them, Hood is a white racist official. Actually, its probably closer to the fact that RSS took shots at the king - and missed - when he tried to indict to Asst AG's. Can't try to overtake the king and fail. Just ask 'former' State Auditor Patterson.

well, if you are anti RSS, you'd better hope the evidence is more compelling that the affidavit's contents. like recordings of those jail meetings that show the contents of the conversations. I certainly have no idea what the meetings were about and no one posting here does either unless McDivitt is posting. I think its interesting that the attached emails and letters weren't posted, at least earlier today when I looked.

I do know this: RSS has had tremendous turnover with his staff and now not one of the original assistants from his 2008 swearing are still with that office. very experienced trial lawyers left for less paying positions, there was an early retirement, one moved to the Ranking County DA and several were fired right after his reelection last august. this may or may not have anything to do with these charges, but it is unusual.

Those commenting are missing the main point here. As KF said:
The affidavit and six charges are posted below. Yes, they are related to the Christopher Butler cases that were reported only here on JJ. Nutshell version: The affidavit alleges the D.A. tried to help a convicted drug dealer get out of jail, visited him in jail, and tried to use a grand jury to get a circuit judge to drop a case against the drug dealer. Yes, it is alleged he tried to use a grand jury to intimidate a judge into dropping a case.

If true, that is one hell of a "misdemeanor."

Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.
